The below are example business release break clauses that can be added and used to a contact.

Business Release Clause for Corporate Tenancy
The Landlord agrees that if the Occupier in connection with his duties in the service of the Tenant should be transferred more than (insert number) miles from the Premises; or if he should leave the employ of the Tenant; or if he should become incapacitated and be unable to continue in the employ of the Tenant; or if the Occupier should die; and written notice of the reason has been given by the Tenant or his agent to the Landlord or the Agent the Tenant or his agent shall have the right to terminate this Agreement by giving to the Landlord or his Agent not less than two months’ prior notice in writing to expire at the end of a period of the Tenancy being the (date) of the month OR ADD THE FOLLOWING but no earlier than the end of the first six months of the Tenancy. The notice of termination is to be delivered to the Landlord or the Agent at the address for service specified in clause (insert number) of this Agreement. Upon the expiry of the notice period this Agreement and everything in it ceases and will be void subject to the rights of the parties for any prior or existing breach of any of the covenants contained in this Agreement.
To avoid doubt between the parties the obligations of the Tenant for payment of Rent and other liabilities due under the Tenancy Agreement will only end at the end of the period of notice and vacant possession of the Premises being granted.

 

Business Release Clause for Tenant in AST or Non HA Tenancy
The Landlord agrees that if the Tenant in connection with his duties in the service of his employer should be transferred more than (insert number) miles from the Premises; or if he should leave the employ of the employer, or if he should become incapacitated and be unable to continue in his employment; or if the Tenant should die; and written notice of the reason has been given by the Tenant or his agent to the Landlord or the Agent the Tenant or his agent shall have the right to terminate this Agreement by giving to the Landlord or the Agent not less than two months’ prior notice in writing to expire at the end of a period of the Tenancy being the (date) of the month OR ADD THE FOLLOWING but no earlier than the end of the first six months of the Tenancy. The notice of termination is to be delivered to the Landlord or the Agent at the address for service specified in clause (insert number) of this Agreement. Upon the expiry of the notice period this Agreement and everything in it ceases and will be void subject to the rights of the parties for any prior or existing breach of any of the covenants contained in this Agreement.

The Tenant agrees that if the Landlord in connection with his duties in the service of his employer should be transferred back to the UK or within (insert number) of miles from where the Premises are located; or if he should leave the employ of his employer, or if he should become incapacitated and be unable to continue in his employment; or if the Landlord should die and the Premises are required for his family or other use; and written notice of the reason has been given by the Landlord or the Agent to the Tenant or his agent then the Landlord shall have the right to terminate this Agreement by giving to the Landlord or his Agent not less than two months’ prior notice in writing to expire after the end of the first six months of the Tenancy. The notice of termination is to be delivered to the Tenant or his agent at the address of the Premises or any other address specified in this Agreement. Upon the expiry of the notice period this Agreement and everything in it ceases and will be void subject to the rights of the parties for any prior or existing breach of any of the covenants contained in this Agreement.
